Abstract Parish of St. Martins, St. John County, Farmer. Will dated 7 May 1822, proved 27 December 1824. Wife Brigit the use and benefit of all real and personal estate until youngest child comes of age. She then to have the profits arising from the farm on which I now live during her life. To son John the Lot 26 he now lives on, containing 125 acres, reserving 5 acres next the shore, and he not to dispose of the Lot until my youngest child comes of age. To son William, if he be living, £10 at the time my youngest child comes of age. To each of my daughters, one cow, one feather bed and bedding, four sheep and the sum of £30, the cow, bed and sheep to be given as their wants may require and my widow sees fit; the £30 to be paid when my youngest child is 21 years of age. Sons James, Thomas and Nicholas residue of estate. Wife Brigit BERRY, friends John FLOYD and David VAUGHAN Junr. executors. Witnesses: Henry S. POWERS, John BROWN Junr., Daniel BROWN. CODICIL dated 18 September 1822 described boundaries of land bequeathed to son John BERRY. Witnesses: Stephen MOSHER, William HODGKINS, Edward MOSHER. Inventory, undated, valued at £750 by John BROWN Junr., Henry POWERS and James MORIN. The file contains documents c.1866, outside the scope of this work. It would seem that the youngest son, Nicholas BERRY, had petitioned the court in an effort to obtain a portion of the estate. In his decision dismissing the action, the Judge of Probate stated, among other matters, that the testator, Jacob BERRY died as long ago as 1824 (cited as 23 November 1824 elsewhere), leaving a family of 12 children, sons and daughters. The widow, Bridgit BERRY is now over 90 years of age and Mr. VAUGHAN, the other executor, is also far advanced in life. The youngest of the children, Nicholas BERRY, was about two years of age at the father's death, would now be about 44 years of age. He left for California about 1839 and did not return until about three years ago.
