Abstract City of Saint John, St. John County. Will dated 1 May 1828, proved 18 June 1828. Wife Mary household furniture, plate, linen, etc. House and Lots where I now reside, being Nos. 208, 209, 210 and 211 on south side of Union Street, extending from the corner of Union and Germain westerly to the house and land in the occupation of Mrs. WIGGINS, widow of Samuel WIGGINS, to wife Mary during her life while widow. At her death or marriage, property to son David J. MERRITT. Wife Mary an annuity of £150 while a widow in lieu of dower right. Land on north side of Market Square extending along Prince William Street as far as the brick building of William Tyng PETERS Esq., with the buildings, one of which now occupied by my son David J. MERRITT and Alexander YEATS, the other in the occupation of Mather HAYDEN, a barber, and the farm called Frog Pond, about 5 miles from the City on the road to Westmorland, 250 acres, purchased from Joseph DALEY, and Lot 587 in the City with the house, now in the occupation of Dina KINGSLEY, a woman of colour, and Lots 1127 and 1128 on the south side of St. James Street in the City, and Fishing Lots 100, 101 and 102 in Carleton, purchased of the administrators of William RODEN, to my son Thomas MERRITT. Farm at Hampton Ferry in the Parish of Hampton in Kings County, purchased from Caleb WETMORE and now in the occupation of Salyer JACKSON, containing 400 acres, and a farm on the northwest side of the Oromocto River in Sunbury County, comprised of Lots 2 and 6, purchased from Nathaniel STIVERS, and the lands and houses on the east side of Prince William Street, the whole of the property purchased from Daniel MICHEAU, John WOLHAUPTER and James TAYLOR, running back to the lands of the late Samuel MILES, now in the possession of Miss FARLEY, to my son David J. MERRITT. Daughter Mary ROBERTS an annuity of £30 during her life and Lots 1027 and 1028 on Queen Street, with remainder to her eldest surviving child on her decease. Executors to place £1,250 at interest for my daughter Julia's support until she attains age 21, and then the entire sum to be at her disposal. A similar sum of £1,250 in trust for my daughter Caroline on the same terms and conditions. Lot 297 in Elliot Row in Saint John and the lot in the Parish of Lancaster fronting on the falls, containing 10 acres, held under a perpetual lease from the Mayor and Aldermen, now in the possession of one CUNNIBLE, to sons Thomas and David as tenants in common. To grandson Robert N. MERRITT, son of Thomas MERRITT, 500 acres of wilderness land in the Parish of Portland adjoining land granted to Thomas MERRITT. To grandson John BURNS £500 to be paid to him at age 21, the interest to be paid in the meantime to his grandmother, my wife, or to this guardian for his support and education. In the case of his death, the said sum to be applied to the education and maintenance of his brother, James Howard BURNS. Residue of estate to sons Thomas and David. Sons Thomas and David MERRITT and Gregory VanHORNE, merchant, executors. Witnesses: James WHITE, N. MILBY, Gregory VanHORNE.
