Fellow bondsman Nathaniel MILLY, both of the City of Saint John. Petition of Sarah GARDINER, widow, stated that the deceased had two children, a daughter married to James CUDLIP Esq., and a son, John SMITH, master of the ship "Ann" belonging to this Port; that petitioner was a sister of the deceased and was employed three years and two months before her death taking care of her, with the understanding that petitioner was to receive a certain annuity left to the deceased by her husband; that petitioner is anxious to have either James CUDLIP or John SMITH administer the estate that they might receive the arrears of the annuity and pay petitioner's claim, but John SMITH has neglected to do so and that James CUDLIP has particularly requested petitioner to take out administration.
