City of Saint John, St. John County, Merchant. Deceased 18 December 1803. Will dated 24 August 1794, proved 29 December 1803. Wife Ann use of one-third of estate for life. Brother Abel SANDS and William WARD to sell real estate and divide among my eleven brothers and sisters and the said William WARD, each to receive one twelfth part. Wife Ann SANDS, brother Abel SANDS and William WARD executors. Witnesses: John HILLY, Mary BLISS, Jonathan BLISS. On 2 April 1804 Ann SANDS petitioned the Surrogate General against granting of executorship to William WARD and Abel SANDS until they give good and sufficient security to perform the intent of the said Will. The petition cited that Abel SANDS was an alien in low circumstances and William WARD was in a state of bankruptcy, an insolvent debtor. On 9 April 1804 Abel SANDS swore that he was a British subject; that during the American Revolutionary War he served in one of His Majesty's Corps of Cavalry, the British Legion, as a Quarter Master and has ever since received Half-Pay as such, and is residing in the State of New York. William WARD stated he went to the State of New York in 1802 and returned to Saint John in the company of Abel SANDS in HATFIELD's Brig. On 26 April Ann SANDS renounced executorship in their favour. Inventory of estate reflects value in excess of £15,000 including the brig "Triumph" and cargo, valued at £3,000, deducting David JOHNSTON's one-fourth part of the vessel and allowing the cargo to pay the expences; two "Imported Horses, 'Eclipse' and 'Phoenix', Four Fillys and one young Colt, sundry shares of Colts as per books, the exact number not known" for which no value was assigned.
