As I have experienced much trouble and perplexity in the management of my real Estate in British North America I am of the opinion that it will be to the advantage of my Family to have them all sold pursuant to the directions of this my Will. All lands situated in the Provinces of Nova Scotia, New Brunswick, Cape Breton and Prince Edward Island to son Augustus Wallet DesBARRES, now of Prince Edward Island, James FRASER Esq. of Halifax and William Hersey Otis HALLIBURTON, Kings Councillor, of Windsor, Nova Scotia, in trust to be sold to the best advantage. Proceeds of real estate and all personal estate, except household furniture and plate, to be divided into ten shares. Wife Martha two shares. Sons James Lutterel DesBARRES, Augustus Wallet DesBARRES and Dolben Windham Henry Leopold Orlando DesBARRES each one share. Daughters Martha Frederica, wife of Doctor James CHALMERS, Isabella Matilda, Clara, Louisa, and Grace Frederica Elliot each one share. Wife Martha all household furniture and plate. Son Augustus Wallet DesBARRES, James FRASER and William Hersey Otis HALLIBURTON executors. Witnesses: Adolphus VIETH, George KLINE, William KLINE. On 16 November 1825, at Halifax, Charles MORRIS Esq., Judge and Surrogate General for Nova Scotia, granted administration of the estate of Joseph Frederick Wallet DesBARRES to Augustus Wallet DesBARRES. In his decision he made reference to a Codicil (missing from the file), dated 10 October 1824 in which Richard BLAIR and James Luttrel DesBARRES were appointed executors and to the granting of probate to James Luttrel DesBARRES, two of the executors, William Hersey Otis HALLIBURTON and Richard BLAIR having declined to prove the will and Augustus Wallet DesBARRES having been absent from the Province and without our Jurisdiction. "The court has now found the deceased, at the time of executing the Codicil, was not of sound and disposing mind, But on the contrary was from mental and bodily imbecility totally incapable of making a Will or any testamentary disposition of his Estate." The Codicil was deemed null and void and the earlier probate revoked.
