There is a prospect of litigation arising out of the division of property formerly belong to John BOLES who left Sussex in 1865 and is now supposed to be dead. The history of the case is that two brother John and James BOLES were left by will an undivided lot consisting of about 12 acres which fronts on Main Street. James sold his undivided share or half the lot. This is now owned by John D. WHELAN who is willing to purchase from the sisters of John the remaining half of the property. The sisters, we are informed, are unable to take the amount offered them and have applied to the equity court to have the property sold. Mr. Whelan wishes a division, but not an equity sale of the property in dispute.
