Résumé City of Saint John, St. John County, Merchant. Will dated 28 October 1800, proved at Halifax, Nova Scotia, by the oaths of various witnesses 10 November - 4 December 1823. Daughter Margaret BLACK an annuity of £100 Sterling for life. Brother James BLACK, now in Aberdeen, £500 Sterling. Brother William BLACK, now in Saint John, £500 Sterling. Brother Andrew BLACK, now in Aberdeen, £500 Sterling. Sister Elizabeth BLACK, now of Aberdeen, £500 Sterling. My step-daughter Mary Stuart McGEORGE £500 Sterling. William SMITH Esq., one of my executors, 100 Guineas to be laid out and applied by him in purchasing a watch for his estate. John BLACK Junior, an infant about twelve years of age, son of Margaret GIBB of Aberdeen, £500 Sterling for his maintenance and education and placing and setting him up in some respected business trade or profession. The said Margaret GIBB £100 Sterling. Isabella KENNEDY of the City of Saint John £100 Sterling. Residue of estate to daughter Margaret BLACK after her attaining the age of 14 years. If daughter Margaret die before age 14, estate to my sister Elizabeth BLACK, Mary Stuart McGEORGE and John BLACK Junior to be divided between them. For the better education of my daughter Margaret, now an infant of the age of fifteen months or thereabouts, I do dispose of the Tuition and Custody of her unto my said Brother William BLACK, my worthy Friend the before named William SMITH of Halifax in Nova Scotia Merchant and my said Sister Elizabeth BLACK until Margaret attains age 21. William SMITH and William BLACK executors. Witnesses: Andrew CROOKSHANK, James SMITH, William DONALDSON. CODICIL dated 25 March 1807. My state and condition altered by marriage to Katharine, daughter of Christopher BILLOP Esq. Wife Katharine one third of real and personal estate for life. Daughter Margaret the further sum of £1,000 Sterling. Any other children that I shall have living, or which my wife shall be pregnant with at the time of my decease, each £1,000 Sterling. Such child or children of my deceased sister Margaret, late wife of William WEDDERBURN of Aberdeen, as shall be living at the time of my death £500 Sterling to be divided between them. Witnesses: Andrew CROOKSHANK, William DONALDSON, Lauchlan DONALDSON. CODICIL dated 15 November 1816. Mentions addition of a daughter and a son to his family. One third of the income of all real and personal estate to wife Catherine during her life. John BLACK, eldest son of my brother William BLACK, £250 Sterling and in case of his death the sum his surviving brothers and sisters. James STUART, the third son of my friend the Honourable James STEWART, 100 Guineas. Appointed wife Catharine, the Hon. James STEWART "One of the Judges of his Majesty's Supreme Court for the Province of Nova Scotia" and my brother Andrew BLACK of [Forestmill] in Aberdeen as additional executors. Witnesses: Alexander FIDDES, Alexander MAY, Thomas ROBERTSON. File contains a petition by the Hon. William BLACK, merchant of the City of Saint John, as one of the executors of his brother's will, praying probate of the same will on the evidence of an authenticated copy of the probate granted in the Nova Scotia Probate Court. The Register of Probate, on 23 April 1824, ruled that the original will must be exhibited before probate could be granted. Will proved at Saint John 24 May 1824.
