Résumé City of Saint John, St. John County, Merchant. Will dated 21 December 1832, proved 30 August 1833. Entire estate to wife Mary SMITH for life while a widow. Brother John SMITH, Peter REED and Angus McKENZIE to divide estate into four equal shares on her death or re-marriage, one share to each of my children Daniel Earl, William James and Eliza Jane, real estate to be transferred immediately, personal portion to be held in trust until they respectively reach 21 years of age, and the income to be used for their maintenance and education in the meantime. The fourth share to be held in trust for daughter Mary Ann, wife of Lewis E. P. SMITH, the interest to be paid to her during her life and while she remains the wife of Lewis E. P. SMITH, and to be conveyed to her in the event of his death. Should she predecease her husband, the share to be divided among her children, and if she leave no children, the share to be divided among my other children. Wife Mary SMITH executrix, and in the event of her re-marriage, my brother to be executor. Witnesses: L. HAZEN, Benjamin PETERS, Thomas RICHARDS.
