City of Saint John, St. John County, Baker. Will dated 22 July 1822, proved 26 August 1822. Wife Mary my household furniture and her apparel. Executors empowered to sell all or part of land heretofore owned by Peter McCALIF and after his death without heirs granted to me by the Crown. Any portion unsold, and all other real estate, to be leased for 20 years, one-third of the rentals to wife for life. Youngest son Charles £10 annually toward his maintenance and education. Eldest grandson Henry, son of my eldest son Henry, annuity of £10 for life. Remaining part of the rentals to be divided into four parts. One part to my eldest son Henry GARDNER, one part to my daughter Mary Ann, wife of John T. YOUNGHUSBAND, one part to and for the use and benefit of my youngest son Charles, and one part for the use and benefit of my grandson Robert WELCH. At the expiration of the 20 years, estate to be divided and distributed, one fourth part to wife Mary, if she still living, the remainder to be divided among my children, one part to son Henry or his children; one part to daughter Mary Ann YOUNGHUSBAND or her children; one part to grandson Robert WELCH as standing in the place of his deceased mother my daughter; and the remaining part to son Charles. Friend Paul PRINCE to be Guardian of son Charles in the event of his mother's death before his coming of age. Wife Mary GARDNER, son Henry GARDNER, son-in-law John Thomson YOUNGHUSBAND, and James WHITNEY, merchant, executors. Witnesses: Isaac L. BEDELL, John GRIGOR, Robert PARKER Junr. CODICIL dated 23 July 1822 stipulated that grandson Robert WELCH to receive only a half of the share provided by the will at the final distribution of estate, but he to receive the full share during the 20 year term previously specified. Annuity of £10 to grandson Henry GARDNER be continued for life. Same witnesses. The widow Mary GARDNER appeared as "Mary CANNON" on an agreement between the executors and William HAMMOND dated 13 August 1835.
